State must compensate Piedad Córdoba with a million dollar sum for 'chuzadas', confirmed the Administrative Court of Cundinamarca

The ruling orders the nation to offer public apologies to the former congressman, in addition to fully reparating members of her family for the interceptions.

José Elver Muñoz Barrera, magistrate of the Administrative Court of Cundinamarca, was the speaker who stated that the events denounced by the then congressman Piedad Córdoba, about alleged interceptions, carried out by the Administrative Department of Security, DAS, were committed.

According to the ruling, the DAS had intercepted Córdoba's phone and his e-mails, as well as those of his family, illegally. It adds that these interceptions had been used to promote a campaign of smear, stigmatization and political persecution.

For the Administrative Court of Cundinamarca, it is clear that the Administrative Department of the Presidency, DAPRE, made requests to the Administrative Department of Security, related to interceptions made to Piedad Córdoba. It also demanded to keep them informed about this “political target of great interest to the National Government”, therefore, “the directors of the DAS collected, analyzed and sent information to the high government, without any legal basis.”

The litigation, which has been going on since 2011, had a first ruling by the Superior Court of the Judicial District of Bogotá, which handed down a conviction, of second instance, against the captains of the National Navy, Jorge Alberto Lagos León and Fernando Alonso Tabares Molina; for carrying out work of collection of recorded material and illegal intelligence, carried out against the then senator.

On August 9 of the same year, Germán Villalba Chávez and Fabio Duarte Traslaviña were sentenced for the crimes of: aggravated concert; unlawful violation of communications and illicit use of transmitting and receiving equipment; in addition, abuse of authority by arbitrary and unjust act in successive and homogeneous competition.

Piedad Córdoba, on his Twitter account, confirmed the conviction, where he says: “For illegal chuzadas and smear campaign against me. Among others, the court forces them to apologize publicly.” However, the ruling does not state that the then-president, Álvaro Uribe Vélez, is the one who should offer such apologies, a request made by the senator.

The court notes:

Within the reparation ordered by the courtroom, he must make to Cordoba, is that the State must pay him more than 100 million pesos, for the repair of her and her family.
