Last Sunday, April 17, the discussion on the controversial Electricity Reform promoted by the president was held at the Palacio Legislativo de San Lázaro Andrés Manuel López Obrador, however, after 11 long hours of discussion, the Tabasco president's project was scrapped, as opposition groups had warned in previous days.
With 275 votes in favor, 223 against and 0 abstentions, federal deputies and deputies rejected the initiative of the president of Mexico that planned to strengthen the Federal Electricity Commission (CFE), however, they did not count on Andrés Manuel López Obrador having an ace up his sleeve and, while they were debating the approval rejection of the Electricity Reform, a proposal for reform of the Mining Law came to the presidency of the Chamber of Deputies.
Thus, with 87 votes in favor, 20 against and zero abstentions, the senators of the republic who promote the government of Andrés Manuel López Obrador (AMLO), approved on Tuesday, April 19, the Reform to the Mining Law (LM), which promotes that the Mexican State will be the only one that will be able to use lithium. In this regard, users on social networks took advantage of the situation to express their opinions through funny memes.
On the morning of April 20, the reform of the Mexican Mining Law was published in the Official Gazette of the Federation, with which it is proposed to protect lithium in the national territory. The opinion dictates amendments to articles one, 9 the first paragraph; 10 also in the first paragraph and an article 5 bis and a third paragraph were added to article 10 of the Act.
This initiative promotes the exploration, exploitation and exploitation of this mineral and its economic value chains to be used exclusively by the Mexican State. It also proposes the creation of an autonomous public body to ensure that the State can take advantage of all the advantages that this metal may attract.
However, the opposition has considered this new reform unnecessary, since they argue that the nationalization of lithium, as well as that of other minerals, were already being found as set out in article 27 of the Constitution.
For their part, supporters of the government of Andrés Manuel López Obrador have celebrated the approval of the reform, arguing that article 27, to which they do so much reference members of the opposition, is insufficient to guarantee the sovereignty of the mineral.
Therefore, in the first instance, the reform declares as its main interest the protection of lithium, a metal used mainly for telephone batteries, computers and other portable electronic devices. It can also be applied in the creation of ceramic glass and lubricating greases.
In the changes proposed by President Andrés Manuel López Obrador and approved yesterday, lithium is declared a public utility metal. It is for this reason that concessions, licenses, contracts, permits or authorizations for its exploitation will not be granted if it is not of a national nature. (according to article 5 bis).
“It is recognized that lithium is the heritage of the Nation and its exploration, exploitation, benefit and utilization is reserved for the benefit of the people of Mexico.”
At the same time, it was determined that lithium economic value chains will be administered and controlled by the State through the public agency referred to in article 10 of the law and that the Mexican Geological Survey will “assist the decentralized public agency responsible for the exploration, exploitation, benefit and utilization of lithium in the location and recognition of geological areas where there are likely reserves of lithium”.
