Marcelina Cundumí Díaz, convicted of corruption, had a current contract with the JEP

The Foncolpuertos Scandal was a case of corruption in which several people were found implicated in falsifying public documents, prevaricating, embezzlement for appropriation and a concert to commit crime, the latter because the authorities found that those involved were charging pensions from the liquidated state company Ports in Colombia. The National Anti-Corruption Unit of the Attorney General's Office prevented two billion pesos from being disbursed and linked 39 people in this scandal.

In this scandal, Marcelina Cundumí Díaz was sentenced on September 22, 2017, by a court in Bogotá to 82 months and 26 days in prison, for the crimes of embezzlement for consummated and aggravated appropriation, inability to exercise public rights and functions, she was fined 500 million pesos, in addition to a ban on the exercise of the right.

But, on December 6, 2018, knowing her status as a defendant, she signed contract 125, that year, where there is also the ink of Harvey Danilo Suárez, the latter representing the Special Jurisdiction for Peace, while Mrs. Cundumi appears as contractor and representative of the Sonia Agricultural Association Cundumi Diaz, ASOSOCUND.

According to El Colombiano, today's Secretary Suárez acknowledged the signing of the contract for almost 6 billion pesos, but that, in this case, the Ministry of the Interior is the entity responsible for reviewing the legal background and requirements, along with other state entities.

In fact, Marcelina Cundumí's case was in the Bogotá Superior Court, which, in 2019, ratified the court's previous decision, where she was banned and disqualified from contracting with the State.

That is why, in a statement, the Special Jurisdiction for Peace announced that it filed a criminal complaint against Marcelina Cundumí, for concealing an inability when signing two agreements with the JEP.

In the publication they say that ASOSOCUND was selected after obtaining the majority of the votes in the Sixth Committee of the National Prior Consultation Space, which means that if they had to review the requirements and background of the firm, which formed a temporary union with the community council of the black community of San Frames.

The statement even states that, at the time of making the agreements, the JEP verified the existence of possible sanctions and disabilities in force for Marcelina Cundumí, in the databases of the Office of the Procurator's Office, the Comptroller's Office and the National Police, where no sanction or disability was reported.

In fact, the JEP states that, through the agreement, socializations, forums and protocols were held among indigenous peoples, blacks, Afro-Colombians, Raizales and Palenqueros in 12 departments.
