INE ordered to withdraw Morena's candidate spot in Aguascalientes

In response, supporters and members of the party criticized the measures taken by the autonomous body

On April 13, the National Electoral Institute (INE) announced that the Institutional Revolutionary Party (PRI) denounced its counterpart: Morena and her Aguascalientes gubernatorial candidate, Nora Ruvalcaba Gámez.

This would have occurred after the dissemination of the promotional called NORA SPOT 4 (which was broadcast on television and radio), for the local electoral process that is ongoing in that entity.

According to the members of the tricolor party, such material “contains claims and slanderous elements”.

It should be noted that in this spot, which circulates on social networks, the candidate for the government of Aguascalientes says:

In this regard, the Electoral Commission ruled that “the precautionary measure is appropriate, considering that the expression “separated stole...” is not generic, since it contains the imputation of a possible crime that does not fall within the concept of opinion or criticism” and is not the issue of a value judgment by the party, but rather there is a direct imputation of acts that could be criminal or unlawful” says the INE statement.

Consequently, the Morena party was ordered to replace the material within three hours of its legal notification.

For her part, the head of the General Secretariat of the National Regeneration Movement, Minerva Citlalli Hernández Mora, expressed her rejection of the measure implemented by the electoral institute and invited social media users to share the spot:

It should be noted that this is not the first spot that the INE has ordered to withdraw. On April 8, the National Action Party (PAN) denounced Movimiento Ciudadano (MC) for slander, resulting from the dissemination of the promotional called Contraste Aguascalientes, in its version for radio and television, to the detriment of the blue and white candidate for the governorship of the entity María Teresa Jiménez.

This complaint was analyzed by the INE Complaints and Complaints Commission, which determined that it was inadmissible. However, the Superior Chamber of the TEPJF revoked the agreement of inappropriateness, arguing that there was “a risk that transcends the greater impairment of a right or a substantial principle in electoral matters”.

This “must be protected in order to avoid statements that could have a negative impact on free and informed voting”, since the spot contained the following phrase: “If this is how you stole as mayor, imagine yourself as governor”, which preliminarily constitutes the charge of a crime or false act against the candidate of the PAN.

So Movimiento Ciudadano had less than 12 hours to remove the audiovisual material and replace it with another one that had “generic” elements. The INE, for its part, was responsible for informing concessionaires not to disseminate the promotional through the Office of the Executive Directorate of Prerogatives and Political Parties.
