Congress of the Republic approved exemption from IGV for food from the basic basket

After rectifying the document, the national representation supported the ruling that complies with the comments of the Executive Branch.

The plenary session of the Congress today approved the opinion on the entry into the comments of the Executive Branch, which establishes the exemption from the General Sales Tax (IGV), for foodstuffs in the basic basket such as chicken, eggs, sugar, uncooked pasta and bread.

The opinion, which was previously approved this morning in the Economic Committee, was supported by a total of 95 congressmen, while 10 spoke out against and three voted for abstention.

The approved standard aims to establish extraordinary measures related to the IGV applicable to the main foods that are part of the basic household basket, in order to mitigate the inflationary impact generated by the international economic situation.

In this regard, as stated in the proposal of the Ministry of Economy and Finance (MEF), that the products that are exonerated from IGV are chicken, chicken eggs, sugar, uncooked pasta and bread, the period of which will last until July 31 of this year

It also states that taxpayers who market the aforementioned goods may apply as a tax credit the IGV corresponding to the acquisitions and/or imports of the main inputs required in the production process of the exonerated goods, which will be determined by a supreme decree endorsed by the MEF.

As for the final supplementary provisions, it refers that the approved provisions shall enter into force from the first day of the month following the date of publication of this law in the Official Gazette El Peruano.

In addition, the Supreme Decree, endorsed by the MEF, establishes the necessary regulatory standards for the proper application of the standard within a period of no more than 15 calendar days.

It adds that the provisions apply to operations involving the import or sale of the aforementioned goods carried out in the areas included in the Amazon covered by the Law on the Promotion of Investment in the Amazon.

Likewise, Indecopi is responsible for monitoring the sales prices to the final consumer of goods that are part of the basic family basket included in this Act.
