According to the Attorney General's Office, José Luis Hernández Grajales had been serving a conviction since 2016 for femicide, violent carnal access and simple kidnapping. At that time, he was tried for the murder of Sandra Paola Morales, in the village of El Jardín, La Selva district, in the municipality of Guacarí, in Valle del Cauca.
According to relatives, Sandra, who suffered from psychiatric problems, was found with a fracture of the septum, bruises on different parts of the body, stems and leaves in the oral region, and signs of sexual abuse.
But, Grajales was serving a 38-year prison sentence in San Isidro prison in Popayán, Cauca. According to the Office of the Prosecutor,
Preliminary investigations show that Grajales was allegedly responsible for the murder of Juan Carlos Guar Sánchez, who was found dead inside one of the cells due to stab wounds and multiple blows. These events would have occurred on April 9.

In the indictment hearings, the Prosecutor's Office prosecutes him for the crime of homicide. The judge decided not to impose an insurance measure since Hernández Grajales is serving his conviction.
In fact, in this same prison, last year the National Penitentiary and Prison Institute, INPEC, reported the death of one inmate and the injuries suffered by three others, in the middle of a fight.
All these problems have led entities such as the Office of the Ombudsman to speak out about the prison crisis; the leader of this body, Carlos Camargo, proposed to reform the prison and prison system, because prison overcrowding exceeds 20%; in fact, he said that the prison system must be reformed be aimed at respecting the human rights of persons deprived of their liberty in order to ensure their re-socialization and prevent recurrence.
