Pedro Pablo Kuczynski will face trial under appearance with restrictions that would imply his freedom, according to Judge Tamariz

New restrictions were applied to the former president, as the judge in charge of his case changed his arrest warrant against him by the Westfield Case, linked to Odebrecht.

The former President of the Republic, Pedro Pablo Kuczynski (PPK) would be released after the judge in charge of his case, Jorge Chávez Tamariz changed his order from house arrest, all this because of the Westfield Capital case, linked to the money laundering case of the Brazilian company Odebrecht.

According to the resolution, obtained by RPP Noticias, the measure was taken because the deadline for the house arrest warrant expires this Sunday, April 10, so the judge ordered that police custody be lifted.

In this way, the judge accepted the request made by prosecutor José Domingo Pérez, part of the Lava Jato Special Team, for PPK to face its mandated sentence to appear with restrictions on the investigation that follows him into his case.

RULES OF CONDUCT

Jorge Chávez Tamariz ruled that PPK must comply with certain provisions of conduct among itself in the first place, is prohibited from communicating with co-accused persons, must appear in court every 30 days to report on its activities, is prohibited from absent from Metropolitan Lima, unless it has authorization judicial, is also prohibited from reporting to the media on this case and must be submitted to the judicial and fiscal authority when required.

In addition, he will not be prohibited from engaging in political activity directly or indirectly due to lack of motivation.

On the other hand, the magistrate scheduled for this Monday, April 11, a virtual hearing, where it will be evaluated at the end of the request of the prosecutor José Domingo Pérez to order the impediment of the former president's departure from the country for 36 months.

It should be noted that the former president weighs two terms of appearance with restrictions and is prevented from leaving the country for 12 and 30 months as part of the investigations which continues to be followed by the cases of the South Interoceanic Highway, linked to Odebrecht, and the financing of its presidential campaign in 2016.

PPK SAYS HE SUFFERS FROM THE SAME AILMENT AS ALBERTO FUJIMORI

In addition, a few weeks ago, PPK warned that he suffers from the same heart disease, ventricular fibrillation, as former president Alberto Fujimori and that it was the reason in 2017 for granting him humanitarian pardon to his predecessor.

This was stated by Kuczynski during the ongoing trial against former congressman Kenji Fujimori, son of Alberto Fujimori, for alleged irregular negotiations to obtain that benefit for his father.

“If fibrillation goes out of control, it can lead to death, (because) I myself suffer from ventricular fibrillation, which is why two years ago I got a pacemaker. So, yes, it's a danger,” he said.

The former ruler, in house detention for three years for another case of alleged corruption in Odebrecht, responded to the judges and lawyers of the accused and refused to recall the text of the report calling for the humanitarian pardon for Fujimori.

In any case, he acknowledged knowledge of the ailment suffered by the former president, sentenced to 25 years in prison for the massacres in Barrios Altos (1991) and La Cantuta (1992), as well as the kidnapping of a journalist and businessman in 1992.

When asked about the route followed by the pardon in the Executive, Kuczynski said he could not “answer exactly”, although he explained that it “goes through the minister of the branch”.

“I think the Minister (of Justice, Enrique) Mendoza should have checked with me his approval,” he explained.
