This Sunday the Government published Supreme Decree No. 003-2022-TR which establishes an increase in the minimum wage or minimum living wage of workers subject to the labor regime of private activity in 95 soles, which will increase from 930 to 1025 soles.
The Supreme Decree published in the Bulletin of Legal Standards of the Official Gazette El Peruano states that this increase in salary will be effective as of May 1, 2022.
MINIMUM WAGE DECREE
The Supreme Decree adjusting the minimum wage takes into account technical criteria for the analysis of core inflation and productivity rates, as indicated in the decree in its recitals.
These are other considerations:
- Article 24 of the Political Constitution of Peru establishes that workers have the right to equitable and adequate remuneration that ensures, for him and his family, material and spiritual well-being; and that it is up to the State to regulate minimum remuneration, with the participation of organizations representing workers and employers.
- It is the responsibility of the State, in accordance with the constitutional mandate and the provisions of Conventions 26 and 99 of the International Labour Organization, (...) to fix the minimum remuneration of workers subject to the labor regime of private activity.
- The readjustment of the minimum remuneration that is available takes into account technical criteria for the analysis of the underlying inflation and productivity rates, so that the increase reflects the economic performance of our country and contributes to the sustained improvement of the purchasing power of workers.
DECREES ON MINIMUM LIVING REMUNERATION
In addition, the standard decrees the following three articles
Article 1. Object of the standard
Increase by S/95.00 (ninety-five and 00/100 Soles) the Minimum Living Wage of workers subject to the private employment regime, thereby increasing the Minimum Living Wage from S/ 930.00 (nine hundred thirty and 00/100 Soles) to S/ 1 025.00 (thousand twenty-five and 00/100 Soles); increase that will be effective as of May 1, 2022.
Article 2. Publication
This Supreme Decree is published on the institutional portal of the Ministry of Labour and Employment Promotion (www.gob.pe/mtpe) on the same day of its publication in the Official Gazette El Peruano.
Finally, they indicate that the rule bears the signature of the President of the Republic, Pedro Castillo, and the Minister of Labour and Employment Promotion, Betssy Chávez.

INCREASE WITH TECHNICAL CRITERIA
For his part, the Minister of Justice and Human Rights, Felix Chero, said that the increase in the minimum living wage responds to a technical criterion and to a need of the working mass
“We must bear in mind that this measure responds to a technical criterion and a need of the working mass, but it is also a constitutional mandate,” he explained this Sunday at a press conference.
“Let us remember that the RMV has not been increased for 4 years in such a way that we consider it reasonable and fair in the country that this remuneration, which increases to S/1,025, is what corresponds in strict legality and in strict analysis of reasonableness,” added the head of justice.
