T he Inter-American Court of Human Rights (IACHR) convened an open hearing to consider deciding on the request for provisional measures “to guarantee the right of access to justice for the victims of the Barrios Altos and La Cantuta cases.” In this regard, the fate of former President Alberto Fujimori, who was reinstated by the Peruvian Constitutional Court, could be discussed.

The session was called for Friday, April 1 at 2:00 p.m. (Peruvian time). The representatives of the victims of these two cases, the Peruvian State and the Inter-American Commission on Human Rights, have been summoned.

Alberto Fujimori: Inter-American Court convenes public hearing

In addition, on March 30, the Inter-American Court issued a ruling on the possible release of the former president and requested the Government of Peru not to do so until the international organization decides on the request for provisional measures to the victims. This is after the Constitutional Court of Peru published the resolution reinstating the pardon in favor of the former president Alberto Fujimori Fujimori.

Previously, the Inter-American Commission had already expressed its disagreement with the ruling of the TC. On March 18, in a statement on his Twitter account, he said that this hindered compliance with the obligations of his own ruling.

“IACHR expresses deep concern over the decision of the Constitutional Court ordering the release of Alberto Fujimori. It affects the victims' right to justice and hinders compliance with international obligations of the Inter-American Court in the Cantuta and Barrios Altos cases, he said in a tweet.

PERUVIAN STATE WILL COMPLY WITH NOT RELEASING ALBERTO FUJIMORI

the Peruvian State will comply with the request of the Inter-American Court and suspended the entire process of Fujimori's release, said supranational prosecutor Carlos Reaño

Reaño Balarezo explained that the provision of the Inter-American Court has a binding nature, therefore, he proceeded to notify the Ministry of Justice, the Attorney General's Office, the National Penitentiary Institute (INPE) and the Constitutional Court (TC) not to the release of the former president is proceeded.

For his part, César Nakasaki, Fujimori Fujimori's lawyer, stressed that “ideology over law prevails in the court today.”

He reported that last Tuesday he sent to the Inter-American Court new information on the state of health of Fujimori, 83, and that he was recently admitted to a clinic after suffering from pulmonary defibrillation.

In addition, the Judiciary last week ordered an impediment to exit and restricted appearance measures for Fujimori in the Pativilca case.

KEIKO DEFENDS HIS FATHER'S FREEDOM

Keiko Fujimori, upon learning of this resolution, published an audio in which he regretted that “a simple document” prevents the release of his father, who is not allowed to enjoy “human rights, even the most elementary right to life”.

“In yet another chapter in a series of injustices against my father, an international court long recognized for its ideological bias now seeks to prevent Alberto Fujimori's release through a simple document, not even a resolution, from being released from prison. My family is in great pain to confirm that when it comes to my father, there are no human rights, not even the most basic right to life,” he said.

Fujimori Higuchi also urged the Government not to accept the IACHR's request, otherwise their family will hold them responsible for what happens to the health of the Patriarch of the Fujimori

“It is in the hands of the Government now to break into a measure as precarious as it is unjust, if there were a minimum of balance in its assessment, it should not disregard the ruling of the Constitutional Court. From giving in to such a perverse and inhumane maneuver, my family holds this Government responsible for the consequences that its decision may have on Alberto Fujimori's life and health,” he continued in the audio. /
