With a vote of 39 expressions in favor, 52 against and four abstentions, the plenary of the Senate of the Republic rejected the point of agreement on the appearance of those responsible for the construction works of the Maya Train, one of the megaprojects of Andrés Manuel López Obrador (AMLO).

On the afternoon of this Wednesday, March 30, the majority of the Movimiento Regeneración Nacional (Morena) and almost all of its parliamentary allies (PES, PVEM and PT) imposed themselves against an opposition that could not cause Rogelio Jiménez Pons, former Maya Train Manager, and Javier May Rodríguez, the new manager, to attend the House of Senators to explain various anomalies that in the eyes of the detractor benches of the 4T must explain.

The history of this point of agreement responds to the demand of Xochitl Gálvez, senator for the National Action Party (PAN), that Jiménez Pons and May Rodríguez abound on the unnecessary cutting, removal and transplantation of more than 20,000 trees that were located on federal highway 307 Cancún-Tulum, in addition to other damage to the environment in the region.

Gálvez Ruiz pointed out that the then head of the National Fund for the Promotion of Tourism (Fonatur) was the one who authorized this measure for the construction of a megaproject section that would have suffered from changes in planning, so he is responsible for explaining this and other measures of environmental impact.

In addition to reviewing the methodology of planning and construction of the work with an ecological vision, the president of the Committee on Indigenous Affairs in the Senate of the Republic requested that information be given on which natural or legal persons were hired to carry out the logging or removal and transplantation, which was carried out by held during the new direction of Fonatur with Javier May.

It also demanded that the technical basis for adopting this decision be given and specifying on what dates the amendment took place. This demand is consistent with Xóchitl Gálvez's activities in relation to the Maya Train, since in previous days, the senator filed the corresponding complaints on this issue with the Attorney General's Office (FGR) and another to the Ministry of Public Service (SFP).

Regarding this incident, the legislator highlighted that the removal of the 20,000 trees was not authorized by the November 2020 Environmental Impact Manifestation (MIA) on the Maya Train construction project nor considered as forest loss, or at least Fonatur does not have it published on its portal, so the apparecencia addresses this inconsistency between the actions implemented with those carried out.

Removal services should not have been contracted or paid for without MIA, as provided for by the Public Works Act and the General Ecological Balance Act. In addition, he regretted that of the 20,000 trees, only 307 were rescued and transplanted in various places in Playa del Carmen, Puerto Morelos and Cancun.

Gálvez Ruiz recalled that the General Law on Administrative Responsibilities punishes the diversion of resources when they are used without legal basis or in violation of applicable laws.

Whereas article 214 of the Federal Penal Code punishes up to two to seven years' imprisonment for damage to places that a public servant has in his care, and article 418 punishes with imprisonment of six months to nine years anyone who unlawfully cuts, pulls, demolishes or cuts down one or some trees.
