Edomex: Reports of human rights violations increased by 22%; FGJEM and Tribunales were the most noted

The report of the Commission on Human Rights of the State of Mexico (Codhem) reiterated that more than 10,000 100 complaint files were filed

In 2021, complaints of human rights violations in the State of Mexico increased by 22% compared to the previous year. This is according to the report of the Commission on Human Rights of the State of Mexico (Codhem), which was presented on March 28 in LXI Legislature of the State of Mexico.

The institutions with the highest number of complaints about violations of this type are: the Attorney General's Office of Justice (FGJEM), municipalities, the penitentiary system, the High Court of Justice (TSJEM) and the State Institute of Health (ISEM).

The report detailed that over the past year, more than 10,000 100 complaint files were filed, equivalent to an average of 843 files per month. The head of the Commission on Human Rights of the State of Mexico (Codhem) Myrna García indicated that 10 “particular” recommendations addressed to the penitentiary system, the public prosecutor's office and the health sector emanated from them.

“For the first time we will address technically and with high responsibility the issues of probable human rights violations due to torture at the municipal and state levels, and the recommendations on amnesty decrees for high-impact crimes and the third principle, effectiveness, because citizens are tired of being fill out papers and in the end the complaints are not resolved,” said the head of the agency.

One day after the presentation of the report, Myrna met with Mr. José Humbertus Pérez Espinoza, representative of the civil organization Presumption of Innocence and Human Rights, with whom he had a dialogue on the issues discussed in the document.

It should be noted that in addition to human rights violations by government entities, emphasis was also placed on the levels of gender-based violence experienced by the entity.

According to data from the Executive Secretariat of the State Public Security System, there was an increase in the crime of rape, since out of 1,056 registered in 2020, there were 1,413 in 2021. The report therefore states that the State of Mexico is one of the entities with the highest gender violence at the national level.

“Unfortunately, 21 of the 100 most violent municipalities for women are Mexicans. In this regard, we have launched active campaigns against gender-based violence, accompanied by training and awareness-raising sessions on this serious problem in the state,” the document states.

On the other hand, on the subject of amnesty, the Commission has the power to refer for analysis and resolution to the judiciary cases that are brought to its attention and that it considers that they are subject to the application of the Amnesty Law. In this regard, more than 2,700 applications have been received to date. It highlights the case of Silvia “N” who received the amnesty on November 25, 2021. It is the first recommended amnesty for serious crime in the entity and was obtained on the basis of article 4, section XII.

At the national level, according to the investigation “The Violation of Human Rights in Mexico 2000-2018: Some Characteristics and Trends in the Light of CNDH Statistics” and between 2000 and 2018, the National Human Rights Commission recorded a total of 130,318 complaint files for the alleged violation of human rights and issued 1, 285 recommendations to different authorities.

Of these, 88% of complaints and 85% of recommendations refer to civilian authorities, Army and Navy.
