Jhonier Leal would only pay 13 years in prison for killing his mother and brother, according to a pre-agreement with the Prosecutor's Office

On the morning of March 29, a new hearing is held in the case of Jhonier Leal. The confessed murderer of his brother and mother began this new process to find out the answers to the pre-agreement he reached with the Prosecutor's Office. Leal, who agreed to have committed the double homicide that was recorded in November 2021, could receive a reduction in his sentence, according to what is stated in the 25-page file. In total, he would be sentenced to 27 years in prison.

“After these macabre events, he was responsible for modifying the scene by cleaning and transferring the mother's body from the third sublevel to Mauricio's room (...) carrying the evidence (wearing gloves) in order to make it appear that it was a suicide”, reads in the preagreement on the acts that Jhonier agreed to have committed.

The pre-agreement states that by accepting the charge of aggravated homicide in conjunction with the crime of concealment, alteration and destruction of material evidence, “the Prosecutor's Office, as the only benefit, grants him a reduction in sentence under article 351 of the Criminal Code, which may go up to half”.

According to what has been advanced, the prosecutor estimates that Leal would be sentenced to 330 months, or 27.5 years in prison. This is in addition to the payment of a fine of 200 statutory monthly minimum wages in force. In addition, as part of the pre-agreement, Jhonier Leal undertakes to publicly apologize to the victims, the country, the community and all those who suffered harm by their actions. The latter is given as an act of reparation.

In addition to these measures, Jhonier was declared incapable of exercising public rights for the same time that he will be deprived of his liberty. The sentence must be served in a prison provided by the National Penitentiary and Prison Institute (Inpec).

“It will also make its express and public expression of its commitment to never reiterate any punishable conduct against any human being”, states the document shared before the 55th Criminal Judge of the Circuit with Knowledge Function of Bogotá. Jhonier had already asked for forgiveness, it is important to note that it was on January 18 that Leal asked for the floor before the Guarantee Control judge and confessed to murdering his mother and later his brother.

“First of all, today I had the opportunity to speak with my lawyer and, after being properly advised, I have made a super important and very personal decision: freely and voluntarily to accept the charges through an agreement with the Prosecutor's Office,” Leal said. The judge, before the confession, assured that while people like him committed these reproachables, people like her would give anything to have their mother alive.

In the pre-agreement, in addition to the notification of the sentence, in exchange for Jhonier's truth about the crimes he committed, details were given of what happened between the night of Sunday 21 and Monday, November 22, 2022 in the 18th house of the Arboleto residential complex, where the renowned stylist, Mauricio Leal, lived, and in where he was found next to his mother, Marleny, lifeless, and with signs of a violent death.

“It was established that the accused today and who has decided to sign a pre-agreement with the Attorney General's Office freely, consciously and voluntarily, entered the Arboleto residential complex on November 21, 2021, being at approximately 11:37 p.m., staying in the same house until 11:15 a.m. on the day Monday, November 22,” said the prosecutor of the case.
