One of the lawyers of the former President of the Republic, Alberto Fujimori, Elio Riera, declared in the morning that the sentenced former president should leave the jail today, this after the Constitutional Court (TC) published the resolution that restored the humanitarian pardon he received in 2017.
“The resolution (of the TC) indicates to provide for immediate release, but the procedural burden of the judiciary is understood,” Riera said in statements with Canal N.
In the same vein, the lawyer explained that the TC must inform the High Court of Justice of the ruling, published on Monday, which declared the “habeas corpus” filed against a Supreme Court decision that in 2018 rendered the pardon of the former head of state ineffective. Once that court receives the sentence, it must send the file to a court in Lima so that it can order his release and finally that order is sent to the National Penitentiary Institute (INPE), the lawyer explained.
“Actually, I think it should come out today. However, we are confident that it can be achieved today or tomorrow at the latest, depending on the procedural burden (of the judges),” Riera said.
Alberto Fujimori is in the Barbadillo Prison, after being discharged a few days ago. Riera explained that the resolution is currently in the Superior Court of Ica.
“The file is currently in the trial chamber. When he receives the ruling of the Constitutional Court, he should refer everything to the court of Lima so that it can be executed and sent to the INPE which has to execute (the release),” he told RPP.
“We have presented the corresponding appeals to Ica. Dr. Natali Santillán is giving her the speed of the case. We understand that it should happen today, but we are respectful of the load and hope that it can be executed,” he added.
It should be noted that the The Constitutional Court formally published the resolution on Monday, March 28, while Congress debated the vacancy motion against the president& nbsp; Pedro Castillo.

The lawyer stressed that Fujimori, 83, has “very delicate” health problems, since he is dependent on medical oxygen, and his environment is looking for “that his health can be stabilized”.
The former president was sentenced to 25 years in prison for two massacres that resulted in the death of 25 people and the kidnapping of a journalist and businessman in 1992, and was serving that sentence in a prison built exclusively for him in a police prison in Lima.
At another time, her daughter Keiko Fujimori confirmed that her father's condition is stable, as mentioned by Inpe workers. “Although he is stable, when he calls me on the phone I feel a little anxious and that is why it is important for us to do all this coordination of the corresponding medical check-ups once he is released,” he said.
He also stated that he has not been able to see his father, since he was only allowed to make the corresponding delivery of food. “They have not allowed me to make the visit nor have they allowed me to enter to deliver their food,” he said.
Finally, he commented that in the afternoon, Dr. Cesar Nakazaki will rule on legal issues involving his father. “Tomorrow there is going to be a hearing, all that is going to be told by Dr. Nakazaki,” he concluded.
