A man, identified as Adrián “N”, was linked to trial for the crime of animal abuse after the Attorney General's Office of the State of Mexico (FGJEM) prove their alleged participation in the event.

According to the account of the facts, the subject, in complicity with another person still in his capacity as unknown, went to his neighbor's building where he opened fire on three of his dogs on March 17, in the municipality of Timilpan,

The dogs, two of Beagle breed and one Husky, died on the site. Meanwhile, its owner remained hidden during the attack to avoid being injured, but managed to realize the facts, so that he was able to file the lawsuit.

In this way, an investigation folder was opened, which led to the arrest of Adrián “N”, who is now proceeding in the Jilotepec Prison as a preventive detention. The authorities granted one month for the closure of the follow-up investigation.

According to the Penal Code of the State of Mexico (Edomex), mistreatment is considered to be the act of causing “willful injury to any animal that does not constitute a plague”, which would mean that Adrián “N” could spend up to six years in prison if found guilty.

The Law for the Protection of Animals considers death caused by prolonged agony and unnecessary suffering as an act of cruelty. However, demonstrations of negligence (such as deprivation of necessary care or other omissions that result in harm to their welfare), as well as torture also fall into this category.

Any person responsible or involved in such wrongdoing - both directly and indirectly - shall be liable to fines of two to 50 times the equivalent minimum wage or severity of the offense. In addition to the respective confiscation of the species.

In addition, on July 30, 2021, the Mexican Congress approved the increase in penalties against animal abuse by spending it from four to nine years in prison for whoever is found responsible for the crime.

With these amendments, the Act may punish with up to six years' imprisonment anyone who causes the immediate death and prolongs the agony of any animal not classified as a plague. However, if the act is committed by a public servant in charge of animals, the penalty is increased to nine years.

For its part, intentional injuries or sexual abuse against animals shall be punishable by four years and with the possibility of increasing to six if the act is photographed, videotaped or disseminated.

Meanwhile, in March 2021, the Chamber of Deputies approved reforms to punish with prison anyone who mistreats an animal or uses it for sexual purposes (zoophilia practices) in Mexico.

The reforms envisage a penalty of three months and up to two years in prison, and a fine of 100 to 150 times the Unit of Measurement and Updating (UMA), who causes suffering to an animal, without causing immediate death; causing life-threatening injuries, or causing permanent injuries or marks.

Another article provides that a penalty of six months to two years in prison and a fine of 100 to 150 times the value of the current AMU shall be imposed on anyone who uses an animal for sexual purposes, as well as on anyone who promotes the sale, distribution, exhibition or dissemination of images, photographs, videos or any other medium in let there be some act of zoophilia.
