Prosecutor's Office rules on interruptions during 'Otoniel' hearings in the JEP

The Public Prosecutor's Office revealed the constant interruptions in the proceedings of the head of the Gulf Clan, as a volunteer before the peace court

After this Friday, March 25, it became known that the Special Jurisdiction for Peace (JEP) rejected the request for reception of Dairo Antonio Úsuga David, alias “Otoniel”, head of the Gulf Clan. The report made by the Office of the Attorney General of the Nation, in the context of the incident of open contempt against the director of the Dijín, General Fernando Murillo, for the constant interruptions during the “Otoniel” hearings in the JEP, in which I act as a volunteer, prior to the decision definitive.

In the Public Prosecutor's Office's document, the Attorney Delegate Alonso Pío Fernández, detailed the information about the two hearings in which 'Otoniel' would appear for the Urabá case and false positives in Casanare, which had to be suspended due to police actions.

It is important to remember that last Wednesday, March 23, the Absence of Truth Recognition Section issued precautionary measures ordering the National Police to guarantee the reservation and privacy of the interrogation, “the director of the Police Dijin, Major General Fernando Murillo, was asked to report on the reasons for security expressed by the police to interrupt the hearing,” the JEP said at the time.

According to the documents, at the hearing held on March 10, which was presided over by Judges Óscar Parra and Hugo Escobar, it had to be lifted due to the presence of “numerous uniformed men armed with rifles, equipment weapons, wearing helmets and balaclavas, who, although the magistrate asked them to do so, never retired on the grounds of reasons of national security”, reads in the document revealed by La W Radio.

During this diligence, the Office of the Procurator stated that absolutely everything that was said at the hearing could be heard, which did not guarantee the reservation in any way. “Judge Oscar Parra Vera requested, on several occasions, that they withdraw from the precinct to which they did not agree. The petitions were submitted to Major Salamanca, who was a “liaison officer”. He stated that he should consult this determination with his superiors,” says the report of the Public Prosecutor's Office.

In turn, the Attorney General's Office added that in the hearing cited for Tuesday, 22 of the same month, related to the participation of the Gulf Clan in massacres and crimes against humanity, committed in Urabá Antioquia, Pío Fernández reported that, in the compound, the location of the places arranged for the attendees to sit had been changed. This meant that the place where 'Otoniel' was going to be was in front of the entrance door. “New seats were allocated for us to sit, and the witness with the defense was close to the sliding glass door of the courtroom,” he said.

The public delegate stated that once the hearing began, chaired by Judge Nadiezhda Henríquez, the robe became aware of the location of the criminal boss and saw that the glass door was not closed. According to the police officers, it had to be open by “security protocols”, a matter that seriously displeased the judge, says the report released by the radio station.

In his report, he also stated that they closed the door again, when without a minute of that movement had passed, it was reopened again by the major surname Salamanca, who indicated that he should remain in that state, which caused the hearing to be ruined and canceled.
