Ibagué Mayor's Office asked to be recognized as a victim in proceedings against the Jamming Festival

The serious complaints faced by Buena Vibra Eventos E.U, organizers of the canceled Jamming Festival, will be added a new position. The Mayor's Office of Ibagué (Tolima), the municipality where the event would take place, asked the Attorney General's Office to recognize the territory as a victim in the criminal proceedings being carried out against the company.

The Mayor's Office argues that in order to allow the event to take place, the city had to invest in logistics. They also point out that, on an individual level, several local entrepreneurs were affected because they intended to sell their products and recover investment during the festival that never happened.

They point out that although several microentrepreneurs managed to sell their products and services, most failed to do so and this resulted in large losses. The hotel sector in Ibagué alone stopped receiving more than 800 million pesos due to the cancellation.

The Secretary of Government assures that together with some state entities and with the help of companies and citizens' initiatives, it has been possible to help those affected, but this is not enough. They argue that Buena Vibra Eventos must respond to the competent authorities.

It should be recalled that the Superintendency of Industry and Commerce (SIC), which had already issued some alerts about the event, announced measures to protect those who are still waiting for their money and those who could buy tickets for Jamming 2023, which the organizers were announcing.

The SIC had asked them for a working group for March 14, but the organizers did not attend, so the entity will open an investigation to the company Buena Vibra for the breach of instructions committed and will assess the legal consequences of canceling the event with a single day's notice.

Finally, the complaints received in relation to this event were transferred to the Office of the Attorney General of the Nation.

For its part, Buena Vibra issued a statement detailing the replenishment options for the more than 150,000 people who purchased a ballot for Jamming. For example, people can change their festival ticket to attend any of the private events they offer at that company.

As for the return of money, they indicated that they will be governed by Article 5 of Decree 818 of June 4, 2020 as to the deadlines they establish for monetary return. This means that, if the health emergency is extended again, Buena Vibra Eventos will have up to one year to make the return.

Thus, the Superintendency of Industry and Commerce cannot do much with regard to the violations caused by this decree.
