On March 17, the Constitutional Court (TC) reviewed and discussed the pending habeas corpus filed by lawyer Gregorio Parco to rescind the Supreme Court's decision in December for the pardon of Alberto Fujimori. The result was in favor of the measure: the former president was pardoned, who was sentenced to 25 years in prison for the Barrios Altos and La Cantuta case.
Previously, a pardon had been given at Christmas 2017 during then-President Pedro Pablo Kuczynski (PPK), who granted the pardon to Fujimori Fujimori for reasons humanitarian. With this new decision, the TC declares one of the three cases seeking the release of the former president founded.
After this event that shook Peru as a whole, the Inter-American Court of Human Rights (IACHR) ruled on its Twitter account where they stated “their deep concern”, for this decision.
“#CIDH expresses its deep concern over the decision of the #Perú Constitutional Court ordering Alberto Fujimori's release, after having been convicted of crimes against humanity”, it reads.
This was not well seen by some parliamentarians and politicians, who expressed their ideas on their social networks.
The first to speak was the parliamentarian and spokesman for Popular Renewal, Jorge Montoya, who believes that the TC “defends the real culprits”.
“It is imminent that we consider withdrawing from a body that only does is defend the real culprits,” the parliamentarian wrote on his Twitter account.
“Many years ago, the IACHR has become supporters of those who actually commit human rights abuses and excesses. That is why they are trying to establish a contrary position against those who fought against desolate terrorism head-on,” he concluded.
CONGRESSMEN AND POLITICIANS SPEAK OUT ON IACHR
ALEJANDRO MUÑANTE - POPULAR RENEWAL CONGRESSMAN
“The Inter-American Court (non-IACHR) does not function as a casatorium, it is a substitute to national law and acts only when internal mechanisms for the protection of human rights fail, and it ensures compliance with the ACHR without violating state sovereignty as stipulated in the Inter-American Charter,” Twitter said.
ANÍBAL TORRES - PRESIDENT OF THE MINISTERIAL CABINET
“This is the pronouncement of the Inter-American Commission on Human Rights @CIDH on the monumental “error” of @TC_Peru”, it reads.
RUTH LUQUE - CONGRESSMAN OF JUNTOS FOR PERU
“Clear and forceful message from the IACHR: “... the restitution of Alberto Fujimori's pardon would be a decision contrary to the international obligations of the State of Peru...” , he commented.
SIGRID BAZÁN - CONGRESSMAN OF JUNTOS FOR PERU
“The @CIDH expresses its “concern” about @TC_Peru's unprecedented decision,” he said.
MARTHA CHAVEZ - FORMER CONGRESSMAN OF POPULAR FORCE
“An act of justice declared in constitutional means that was the route recommended by the IACHR itself (so expensive for the persecutors of former Pdte. Fujimori) when the onegeros complained about the pardon granted. The null and void decision of provisional judge Nuñez Julca is amended,” he said.
“It is appropriate to recall that the IACHR's ruling against Peru in the La Cantuta and Barrios Altos cases was handed down after the government of corrupt Toledo, full of oenegeros, came to the accusations,” he added.
“While @CIDH is concerned, let it read “deeply” Art. 4.6 of the American Convention on Human Rights and begin by having it and @CorteIDH apply “conventionality control” to their recommendations and decisions. Doctors heal yourselves!” ended.
LUCHO DURÁN - PRESIDENT OF THE MORADO PARTY
“Respect for the Constitution and the position of the @CIDH is imperative. A person convicted of violations of human rights and crimes against humanity should not be released. For this reason, and in honor of the victims, the @TC_Peru must respect the sentence is served without interference,” he said.
