Hector Julio Alfonso López, son of alias 'La Gata', was rejected by the JEP

The Special Jurisdiction for Peace affirmed that its contributions to truth and reparation have been insufficient. Now, the ordinary justice system will have to continue the process that links it with paramilitary groups

Since 2018, when he was captured and sent to prison for his ties with paramilitary groups, Hector Julio Alfonso López, asked the Special Jurisdiction for Peace (JEP) to enter transitional justice as a non-member State agent of the public force, arguing that the facts for which he is investigated have directly related to the armed conflict.

The allegations against López, son Enilce López alias “La Gata”, are based on funding by illegal groups, for his political campaign as representative to the House in 2006 by the department of Bolívar.

But on the morning of this Friday, March 18, Caracol Radio revealed that the Room for the Definition of Legal Situations of the Special Jurisdiction for Peace (JEP), decided that it will not be accepted in that justice because its proposals for contribution to the truth and reparation of the victims did not go beyond what was already known in the ordinary courts and does not contribute to clarifying patterns of macro-crime or other phenomena related to the armed conflict in Colombia.

“In accordance with the considerations set out in this resolution, Mr. Héctor Julio Alfonso López's request for submission to the JEP cannot be accepted, as the jurisprudential assumptions established for persons who voluntarily require access to this scenario of transitional justice as State agents not members of the security forces”, the JEP document reads.

It should be noted that in 2019 the Supreme Court of Justice had refused to refer this case to the JEP, arguing that the events for which Alfonso López was being prosecuted “had nothing to do with the armed conflict, since his relationship with the paramilitaries would have occurred after the demobilization of those groups.”

Now with the decision of the jurisdiction of peace, the case against the former senator will again be referred to the Special Investigation Chamber of the Supreme Court of Justice. Therefore, the ordinary courts will be responsible for conducting the process that investigates it because of its links with the blocks Heroes of the Montes de María, Central Bolivar and North of the United Self-Defense Forces of Colombia. The accused is currently being held in La Picota prison in Bogotá.

The information revealed by the media, evidenced López's maneuvers to distort the ties of his relatives with paramilitary groups, despite the fact that they have been sentenced for links with this extinct criminal group.

“He made demonstrations both against his own behavior and against the actions of his family group that are contrary to the abundant evidence gathered by the ordinary courts, particularly as regards their relations with the AUC and the way in which they channeled illicit money through their companies”, says the decision of the transitional justice system.

This is the second son of Enilce López aka 'La Gata' to whom the JEP says no. On February 15, he rejected Jorge Luis Alfonso López, alias 'El Gatico', former mayor of Magangué, Bolívar, because he did not present a clear and real commitment either.
