The legal conflict between Televisa and Doña Cuquita Abarca, Vicente Fernández's widow, seems to have no end, as the dynasty's legal efforts have been fruitless to prevent the broadcast of the series El Último Rey.
In a statement, the law firm in charge of defending the Fernández Dynasty, Del Toro Cazo, announced that things are going from strength to strength against Televisa.
So far, according to the defense, they have a cumulative of three suspensions by different amparo judges for the measures imposed by the Institute to take effect Mexican Industrial Property (IMPI) against the company.
The previous ones order to immediately stop broadcasting the singer's “illegal bioseries”, in addition to the fact that the measures cannot be lifted by the institute.
“In addition, it has the effect of ensuring that Vicente Fernández's copyright and trademark rights are not further invaded, avoiding unfair competition due to the illegal bioseries,” they said in the statement.
However, they emphasized that both Televisa and several companies in the same group have been challenging these measures, even though they were duly notified.
The amparo trials have file numbers 450/2022, 502/2022 and 461/2022, from the Third, Fifth and Seventh District Administrative Court of Mexico City, respectively.
The first specified: “The provisional suspension is granted for the effect that IMPI does not carry out the lifting of the provisional measures.”
The second stated: “Provisional suspension for the purpose of keeping things in the state they keep, that is, so that the measures continue to have their effects in order not to invade the reservation of rights of Vicente Fernández”.
Finally, the latest provisional suspension states that “because they are violations of intangible rights to the detriment of the complainant,” Televisa will not be able to “show any opposition to the lifting of measures that were decreed, which are already completed and in force”.
For this time, the Las Estrellas programming has not removed from its schedules the broadcast of El último Rey, because for Tuesday, March 22, 2022 they have it planned at 8:30 p.m.
This came to light after Infobae Mexico revealed that a federal judge granted the provisional suspension to the television station to continue with the transmission of the biographical series.
Through the Council of the Federal Judiciary, the provisional suspension of the precautionary measures imposed by IMPI was determined until March 22 when the final resolution of the administrative process will be determined.
The temporary resolution was given by Celina Angelica Quintero Rico, judge of the Seventeenth District on Administrative Matters of Mexico City.
On the other hand, Televisa Univision noted that the broadcast of the first episode was well received by the public. According to the broadcasters' bulletin, the first chapter of Juan Osorio's production reached more than 8 million viewers.
To determine the rating of the series, the television stations analyzed public comments through focus groups, so Televisa and Univision concluded that “the dramatic force of the plot, the performances and the high production values of the series largely met the expectations of the admirers of the music icon”.
