Alberto Fujimori: The Office of the Ombudsman rules against the annulment by TC of the judicial decision

The PJ resolution stated that the supreme resolution granting pardon to Alberto Fujimori did not sufficiently state the medical reasons.

The Office of the Ombudsman ruled against the decision of the Constitutional Court on 17 March to annul the decision annulling the pardon granted to Alberto Fujimori on December 24, 2017. This opens up the possibility that the former president will be pardoned the same day.

This decision of the Supreme Court refers to the revision of a habeas corpus filed by the lawyer Gregorio Parco, with the same purpose of repealing the decision of the judiciary.

Through its Twitter account, the Ombudsman's office made its position clear. The entity also mentioned the report “Pardon and pardon granted to former president Alberto Fujimori: normative and jurisprudential evaluation” written by that.

“Our institutional position on the pardon granted to former President Alberto Fujimori can be found in the Ombudsman's Report No 177. Among his conclusions, he points out that the supreme resolution that granted it did not sufficiently express the medical reasons that supported it, they said in a tweet.

“Nor did R.S. need criminal procedures in which the right of pardon worked. In addition, we believe that the victims should have had the opportunity to express their views on the granting of the presidential pardon, which was not the case, they added.

The pardon granted to Alberto Fujimori was granted at Christmas 2017, and was granted by the then president Pedro Pablo Kuczynski granted the pardon to Fujimori Fujimori for reasons humanitarian workers.

The Constitutional Court will discuss the lawyer's habeas corpus on 17 March 2022. On this occasion, Ernesto Blume will be the rapporteur. If approved, the judiciary's decision to cancel the pardon would be void and would release Alberto Fujimori, sentenced to 25 years in prison for the crimes of La Cantuta and Barrios Altos.

On the other hand, everyone knows that the positions of the judges of the TB would be divided. On the one hand, they would be opposed to the release of Fujimori: Marianella Ledesma, Eloy Espinosa-Saldaña and Manuel Miranda; while Blume, José Luis Sardón are in favor. Augusto Ferrero Costa, the current president of the Constitutional Court, could have a decisive vote, and according to what is known, he could vote in favor of the former president.

On 3 March, Essalud reported that Fujimori had been rushed to the II Vitarte Hospital from Barbadillo prison. After being stabilized by the shock trauma doctors, he was transferred to the Centenario Clinic, where he carried out his treatment, at the request of the patient and the INPE doctor.

A few days later, on March 14, Alberto Fujimori was released from the Centenario Clinic and will continue his treatment of pulmonary fibrosis and atrial fibrillation in Barbadillo prison, according to his daughter and head of Fuerza Popular, Keiko Fujimori.

“He will remain under strict medical supervision of his two main conditions: fibrosis and atrial fibrillation. I am grateful, on behalf of my brothers, for their concern and we ask them to pray for their speedy recovery,” said Keiko Fujimori via her social media.
