Alberto Fujimori will be released from prison in the next few days. The Constitutional Court (TC) decided this after reinstating the pardon granted in 2017 by declaring the habeas corpus presented in favor of the former president founded.
Upon learning of the ruling, Fujimori Fujimori's first reaction was to keep a long silence, as revealed by his lawyer César Nakasaki, who was the first to break the news inside the Barbadillo prison, located in the district of Ate, where he was serving a 25-year prison sentence for crimes against humanity.
“I just talked to President Fujimori and I communicated to him the courageous and historic sentence that the Constitutional Court has drawn by a majority, (...) he had a deep silence and we gave each other a big hug, I tell him to enjoy this moment of happiness. He didn't know the news, I heard it from you, the press, imagine him?” , told the media outside the Barbadillo prison.
“(When he heard the news of his pardon) The president was thrilled, the pressure is being measured. He obviously felt a great relief because, as we had already talked with the president, it was totally unfair that he should die in prison. This is not an issue of impunity, he has been in prison for years now, it is not about avoiding punishment, what is about evaluating whether it is human for a man to die in prison”, he continued.
Likewise, Elio Riera Garro, also a defender of Alberto Fujimori, said that the former president received the news of his release with great optimism, and that he is only waiting for the statement of the TC to take effect.
“Mr. Fujimori has received this pleasant smile with great optimism, especially in the hope that all Peruvians will unify, because the important thing is to look to the future and move forward, that is how he is taking it,” said Riera Garro.
“It is now up to us, as a legal area, to make the administrative procedures necessary to be able to finally execute the pronouncements already issued by the Constitutional Court,” he added.
KEIKO FUJIMORI REACTIONS
Regarding the first reactions of her daughter, former presidential candidate Keiko Fujimori, Kakasaki commented that she has not yet met her father after the decision of the Constitutional Court, but that she is satisfied to learn that she will soon be by her side and released.
“He has the satisfaction that his father is not going to die in prison. She is not going to come to the prison today, the prison is functioning normally and has schedules, they can't come at any time they want either,” said the lawyer.
“I think we are going to wait for the order of liberty. There is a small procedure that has to be followed,” he added.
WHEN WILL ALBERTO FUJIMORI GET OUT OF PRISON?
Although Fujimori has already been released, he will remain in prison for a few more days. The defense of the former president explained that, due to bureaucratic processes, his release will not be given immediately and will take longer than expected.
“It is up to the TC to officiate the supreme criminal execution judge, who is the one who gives the order of freedom. He is now the supreme judge of Criminal Execution who will order that the effects of the pardon granted by former President Pedro Pablo Kuczynski be restored,” Nakasaki told the press.
“I just spoke to President Fujimori. Now what is appropriate is that the judge of the order of liberty, calculated that between tomorrow and Monday the office of liberty must be sent. So between Monday or Tuesday, INPE will order the release of prison,” he added.
